1. AGREEMENT AND ACCEPTANCE

Bechify Pakistan, operated by PRIMEARZ LLP (referred to as “Bechify,” “we,” “us,” or “our”), provides an online marketplace platform including classified advertisements, product listings, and community forums (collectively referred to as the “Service”) accessible through the website bechify.pk, mobile applications, and related digital properties (collectively, the “Website”).

These Terms and Conditions (the “Terms”) apply to all users of the Service, including browsers, vendors, sellers, buyers, and contributors of content. The terms “you” and “your” refer to any individual or entity that accesses, browses, or uses the Website or Service in any manner whatsoever.

By accessing, browsing, or using the Website or Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you must immediately discontinue use of the Service.

2. SERVICE DESCRIPTION

2.1 Platform Nature

Bechify Pakistan operates as an intermediary marketplace platform that enables users to:

• List and advertise products, services, and classified advertisements
• Browse, search, and discover listings from other users
• Communicate directly with other users regarding potential transactions
• Post reviews and ratings based on their experiences
• Participate in community features and discussions

2.2 No Transaction Involvement

Critical: Bechify acts solely as a platform connecting buyers and sellers. WE ARE NOT A PARTY TO ANY TRANSACTION between users. All transactions, including negotiations, payments, product delivery, quality verification, and dispute resolution, occur directly and exclusively between the buyer and seller.

The Service may facilitate payment options through third-party providers (including Cash on Delivery, EasyPaisa, JazzCash, bank transfers), however we do not:

• Handle, process, store, or hold any payments between users
• Take custody of products or act as an intermediary or escrow service
• Verify the authenticity, quality, safety, condition, or legality of products listed
• Guarantee the accuracy of product descriptions, pricing, or any seller representations
• Assume any liability whatsoever for non-delivery, defective products, fraud, or any other issues

2.3 Physical Products and Listings

The platform supports both traditional classified advertisements and physical product listings with these features:

• Cash on Delivery (COD): Sellers may offer COD where payment is collected upon delivery
• Seller-Defined Refund Policies: Each seller independently establishes their own return and refund policies
• Buyer Reviews: Buyers may leave reviews and ratings after transactions
• Direct Communication: All negotiations and communications occur directly between parties

2.4 Content

You acknowledge that we do not pre-screen, verify, approve, or endorse any content posted on the Service, including product listings, user profiles, comments, reviews, or advertisements. You may encounter content that is inaccurate, misleading, fraudulent, offensive, inappropriate, objectionable, or in violation of laws or intellectual property rights.

We reserve the right, but assume absolutely no obligation, to monitor, review, edit, or remove any content at our sole discretion, particularly when violations are reported. However, we cannot and do not guarantee that all problematic content will be identified or removed.

3. USER ELIGIBILITY

3.1 Age Requirements

The Service is intended for individuals who are:

• 18 years of age or older and legally capable of entering binding contracts under applicable law
• Minors (under 18 years) may only access the Service with explicit parental or legal guardian consent and supervision
• Children under 13 years of age are strictly prohibited from accessing or using the Service

3.2 Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the confidentiality of your password and account credentials
• Accept full responsibility for all activities that occur under your account
• Immediately notify us of any unauthorized account access or security breach

3.3 Account Termination

We reserve the absolute right to suspend, disable, or permanently terminate your account at our sole discretion, without prior notice, explanation, or liability, for any reason or no reason at all, including if we determine that you have:

• Violated any provision of these Terms
• Engaged in fraudulent, deceptive, or illegal activities
• Posted prohibited or harmful content
• Received complaints or negative reports from other users
• Attempted to manipulate reviews, ratings, or platform features
• Engaged in any conduct we deem inappropriate or harmful to the Service

4. PROHIBITED CONDUCT AND CONTENT

4.1 General Conduct

You agree NOT to:

• Post false, misleading, deceptive, or fraudulent information
• Impersonate any person or entity
• Harass, threaten, abuse, or discriminate against other users
• Engage in any activity that disrupts or interferes with the Service
• Use automated bots, scripts, crawlers, or scraping tools
• Attempt to gain unauthorized access to systems, accounts, or data
• Circumvent any security features or access controls

4.2 Prohibited Content

You agree NOT to post content that:

• Violates any local, national, or international laws or regulations
• Infringes any intellectual property rights, copyrights, trademarks, or patents
• Is obscene, pornographic, defamatory, hateful, violent, or discriminatory
• Exploits, endangers, or harms minors in any way
• Contains viruses, malware, or other harmful code
• Promotes illegal activities, scams, or fraudulent schemes
• Violates privacy rights or discloses personal information without consent
• Constitutes spam, unsolicited advertising, or chain letters

4.3 Prohibited Items

The following are strictly prohibited from being listed:

• Weapons, ammunition, explosives, and hazardous materials
• Illegal drugs, controlled substances, and drug paraphernalia
• Counterfeit, replica, or fake branded products
• Stolen property or illegally obtained items
• Adult content, services, or explicit material
• Human body parts, organs, or bodily fluids
• Live animals (unless compliance with regulations is demonstrated)
• Tobacco, alcohol, and prescription medications without proper authorization
• Gambling services, lottery tickets, or games of chance
• Academic dishonesty services

5. CONTENT LICENSE AND OWNERSHIP

5.1 User Content License

You retain ownership of original content you create and post. However, by posting content to the Service, you grant us an irrevocable, perpetual, worldwide, royalty-free, non-exclusive, transferable, and sublicensable license to use, reproduce, modify, adapt, create derivative works, publicly display, distribute, and incorporate your content for any purpose, including promotional and commercial purposes.

This license includes the right to apply watermarks, logos, or branding to your images and store your content in our databases.

5.2 Content Warranties

By posting content, you represent and warrant that:

• You own or have necessary rights and permissions for the content
• Your content does not infringe any third-party rights
• You have obtained consent from individuals appearing in your content
• Your content complies with all applicable laws and these Terms

5.3 Platform Intellectual Property

All content, materials, features, and intellectual property on the Service (excluding user-generated content) are owned by us, including website design, software, source code, trademarks, logos, and brand names. You are granted a limited, non-exclusive, non-transferable, revocable license to access the Service for personal, non-commercial use only.

You may NOT copy, reproduce, distribute, reverse engineer, decompile, or use our content for commercial purposes without written permission.

6. TRANSACTIONS

6.1 User Responsibility

WE ARE NOT INVOLVED IN ANY TRANSACTIONS. All aspects of buying and selling—price negotiations, payment terms, delivery, product quality, authenticity, refunds, returns, and dispute resolution—are solely the responsibility of the buyer and seller.

6.2 Cash on Delivery

Sellers may offer Cash on Delivery. In such cases:

• Payment is collected by the seller or their agent at delivery
• We do not handle, process, or verify COD payments
• Buyers should inspect products before payment where possible
• All disputes must be resolved directly between parties

6.3 Seller Policies

Each seller is responsible for establishing and communicating their own refund and return policies. We do not enforce, guarantee, or verify seller policies. Buyers should review policies before purchasing and contact sellers directly regarding any issues.

6.4 Platform Fees

We may charge fees for premium services such as featured listings, promoted ads, premium memberships, or verification services. All fees are non-refundable unless otherwise stated. Payment does not guarantee results. Fees are subject to change.

7. REVIEWS AND RATINGS

7.1 Review System

Users who complete transactions may rate and review their experiences. Reviews should be honest, accurate, relevant, respectful, and legal.

7.2 Prohibited Practices

The following are strictly prohibited:

• Posting fake, fraudulent, or paid reviews
• Offering incentives for positive reviews
• Posting malicious reviews for competitors
• Creating multiple accounts to manipulate ratings
• Threatening users to change or remove reviews

We may remove reviews that violate guidelines and take action against accounts, but we cannot guarantee detection of all violations.

8. DISPUTES AND LIMITATIONS

8.1 Direct Resolution

Users should first attempt to resolve disputes directly through respectful communication.

8.2 No Mediation Obligation

We are under no obligation to mediate, arbitrate, investigate, or resolve disputes between users. Any assistance provided is voluntary and at our sole discretion.

8.3 No Liability

We shall NOT be held liable for:

• Non-delivery of products or services
• Defective, counterfeit, or misrepresented products
• Payment disputes, fraud, or scams
• Personal injury or property damage from transactions
• Loss of data, profits, or opportunities
• Unauthorized account access
• Third-party actions or content
• Any user conduct or interactions

9. INTELLECTUAL PROPERTY

We respect intellectual property rights. If you believe content infringes your rights, submit a notification containing:

• Your signature or authorized representative’s signature
• Identification of the infringed work
• Identification of the infringing content (listing ID, URL, description)
• Your contact information
• A good faith statement that use is unauthorized
• A statement of accuracy and authorization
• An indemnification holding us harmless from third-party claims

We may terminate accounts of repeat infringers at our discretion.

10. PRIVACY

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

11. DISCLAIMER OF WARRANTIES

The service is provided “as is” and “as available” without any warranties of any kind, either express or implied.

We explicitly disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding accuracy, reliability, or completeness of content
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding quality, safety, or legality of products or services

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from or related to your use of the service.

This includes damages arising from:

• Use or inability to use the Service
• Unauthorized access to accounts or data
• User-generated content or user conduct
• Transactions between users
• Reliance on any information from the Service
• Interruption, suspension, or termination of the Service
• Any errors, mistakes, or inaccuracies of content
• Personal injury or property damage
• Bugs, viruses, or malicious code

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST SIX MONTHS. IF YOU HAVE NOT PAID US ANYTHING, YOU ACKNOWLEDGE THAT YOUR SOLE REMEDY IS TO STOP USING THE SERVICE.

13. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Bechify Pakistan, and our officers, directors, employees, contractors, agents, and suppliers from any claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney’s fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your content or listings
• Any transactions or disputes with other users
• Your violation of any laws or regulations

This obligation survives termination of these Terms and your use of the Service.

14. TERMINATION

14.1 By You

You may terminate your account at any time by contacting us or using account settings.

14.2 By Us

We reserve the right to suspend or terminate your account, remove content, and restrict access at our sole discretion, without notice or liability, for any reason or no reason, including:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• User complaints or reports
• Extended inactivity
• Law enforcement requests
• Technical or security concerns
• Any other reason we deem appropriate

14.3 Effect

Upon termination, your right to use the Service ceases immediately. All listings are removed. Outstanding fees remain due. Certain provisions survive termination.

15. GOVERNING LAW

These Terms shall be governed by the laws of Pakistan. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Lahore, Pakistan.

By using the Service, you consent to this jurisdiction and waive any objections to venue or inconvenience of these courts.

16. MODIFICATIONS

We reserve the right to modify these Terms at any time without notice. Changes are effective immediately upon posting. Your continued use after changes constitutes acceptance. If you disagree, you must stop using the Service.

17. GENERAL

17.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us.

17.2 Severability

If any provision is found invalid, the remaining provisions continue in full effect.

17.3 No Waiver

Our failure to enforce any right does not waive that right.

17.4 Assignment

You may not assign these Terms. We may assign them freely.

17.5 Force Majeure

We are not liable for failures due to circumstances beyond our control.

17.6 No Partnership

These Terms do not create any partnership, joint venture, employment, or agency relationship.

By using the Service, you acknowledge that you have read, understood, and agree to these Terms. You acknowledge that these Terms constitute a legally binding agreement.
